Contractor Guidelines |
These Street Tree Regulations apply to persons engaged in the handling and care of street trees.
All persons and entities (the "Contractor") offering to perform any type of services related to the planting, removal
or maintenance of street trees in the City of Philadelphia, including spraying, pruning and root pruning (the "Work")
shall comply with all the following regulations:
Before performing any work, the Contractor shall obtain a work permit (the "Permit") from the Fairmount Park
Commission. The permit application is free-of-charge and can be obtained by calling the Street Tree Management Division at 215-685-4363, e-mailing fpc.streettree@phila.gov or writing to the Fairmount Park Commission, Street Tree Management Division, One Parkway - 10th Floor, 1515 Arch Street, Philadelphia, PA 19102.
For Contractors not currently on the Fairmount Park Commission's approved street tree contractors' list, the initial
permit request shall be accompanied by an on-site inspection by the Commission's District Arborist or tree inspector
while the work is being performed.
All Contractors must comply with the following procedures:

Insurance: procure and maintain all insurance policies required herein for a minimum term of one year per occurrence.

Comprehensive General Liability Insurance
-
Limit of Liability: $1,000,000.00 per occurrence combined single limit
for bodily injury (including death) and property damage liability.

Worker's Compensation and Employer's Liability:
-
Worker's Compensation-Statutory limit; all states endorsement

Employer's Liability:
-
$1,000,000.00 Each Accident-Bodily Injury by Accident
-
$1,000,000.00 Each Employee-Bodily Injury by Disease
-
Automobile Liability
-
Limit of Liability:
-
$1,000,000.00 per occurrence combined single limit for
bodily injury (including death) and property damage
liability
-
Coverage: owned, non-owned and hired vehicles

Property Coverage
-
Limit of Liability: $1,000,000.00

All insurance policies shall provide for at least thirty (30) days prior written
notice to be given to City in the event coverage is materially changed, canceled
or not renewed. At least ten (10) days prior to the expiration of each policy,
Sponsor shall deliver to the Fairmount Park Commission an original certificate
evidencing a replacement policy to become effective immediately upon the
termination of the previous policy.

A certificate of said insurance policy shall be placed on file with the Fairmount
Park Commission on a yearly basis:

Sign an agreement to indemnify and hold the City of Philadelphia and the Fairmount
Park Commission harmless from any and all claims of whatsoever nature arising from
damage to property, or injury to any persons, however caused, by the Contractor, the
Contractor's agent, servant, or employee.

Maintain what is to be considered the minimum in equipment for the efficient and
accepted practice of tree work: an enclosed truck body, a brush chipper and adequate
safety devices, i.e. traffic signs, traffic pylons, etc.

Contractors are responsible to notify PA One Call System when appropriate and to
secure all permits required before performing any work.

Contractors must perform the Work in good, workmanlike fashion and, in addition,
shall comply with the following conditions at all time:

The contractor shall follow accepted standards in the pruning of street trees,
including those standards provided by the International Society of
Arboriculture.

There shall be no topping of street trees except by written permission of the
Fairmount Park Commission.

All large, established trees shall be trimmed to a sufficient height to allow for
pedestrian or vehicle traffic -- 10 feet over sidewalks, 12 feet over streets and
16 feet over principal traffic thoroughfares.

Whenever street closures are required in order to perform any of the actions
licensed by the permit, the Police, Fire and Streets Departments shall be
notified of the location and length of time that such streets will be so blocked.
A street closure permit can be applied for through the Streets Department by
calling 215-686-5524 or 5525. Please note that applications should be
received by the Streets Department by 3 pm, ten business days prior to the job
except in the case of an emergency, e.g. trees have fallen on a house.

When a street tree is removed, no wood, whether it be the limbs or tree trunk, shall be
left overnight on the sidewalk or curbline.

Upon removal of a street tree, the contractor will have five (5) working days to have
the remaining stump ground out in the proper fashion.

Permits obtained are subject to revocation by the Fairmount Park Commission.

Upon sufficient notice to the Contractor, the Commission, at its discretion, may order
the contractor to post a performance bond to guarantee work performance.

Each tree planted shall be of sufficient size, 2-1/2" caliper minimum, staked, guyed and
wrapped and back-filled with approved material as shall be ordered by the Fairmount
Park Commission.

Any trees improperly planted, in accordance with these regulations, will be subject to
removal and replacement at the expense of the licensee.

Any pesticide application shall comply with the appropriate local, state and federal
regulations. A copy of the Contractor's Pennsylvania Agriculture Department
Pesticide Applicator's License and Business number shall be kept on file with the
Fairmount Park Commission.
The above regulations are not meant to be an all-inclusive list
but general guidelines which can be amended by
the Fairmount Park Commission at its discretion.
